TERMS AND CONDITIONS OF SALE

The owner of the online store Lux Lashes (hereinafter the Online Store) is Lux Lashes OÜ (registry code 16818530), located at Ringi 4, Pärnu 80010, tel +372 554 0615, e-mail address luxlashes.ou@gmail.com.

1. Validity of the Sales Agreement

The terms and conditions apply to the legal relationships arising between all persons (hereinafter: the Customer) and the Online Store as a result of purchasing goods via Lux Lashes. The Online Store reserves the right to make changes to the sales conditions. These changes are reflected on the website www.luxlashes.ee. The Customer has the opportunity to review the terms before making a purchase, and by completing a purchase, the Customer agrees to the provisions set forth in the terms. In addition to these terms, purchases made from the e-store are subject to the legal acts in force in the Republic of Estonia, including the Law of Obligations Act (VÕS), the Consumer Protection Act (TKS), and other legislation.

2. Product and Price Information

The prices of the products sold in the Online Store are indicated next to the products. All prices in the Online Store include VAT. A delivery fee will be added to the price. All prices for goods sold in the online store are in euros. The delivery fee depends on the buyer's location and the delivery method. The delivery fee is displayed to the buyer during the checkout process. The transport price includes VAT. The Online Store Luxlashes.ee reserves the right to make changes to the sales prices. These changes are reflected on the website www.luxlashes.ee. Information about the goods is provided in the Online Store directly next to the item.

3. Placing an Order

To order goods, the desired products must be added to the shopping cart. To complete the order, the required data fields must be filled in, and a suitable delivery method must be selected. The total cost will then be displayed on the screen, which can be paid securely via the following payment methods:

  • Estonian bank payments: Swedbank, SEB, Luminor, LHV, Coop Pank, Citadele, Pocopay. NB! When paying via a bank link, be sure to click the "Back to merchant" button on the bank's page. Payments are mediated by Maksekeskus AS. Payment takes place outside the Online Store in a secure environment – via bank link in the secure environment of the respective bank and via credit card in the secure environment of Maksekeskus AS. The seller does not have access to the customer's bank or credit card details. The agreement enters into force upon receipt of the amount due to the Online Store's current account. The owner of the Online Store is the controller of personal data and transmits the personal data necessary for making payments to the processor Maksekeskus AS. If the ordered goods cannot be delivered due to being out of stock or for any other reason, the buyer will be informed as soon as possible and the money paid (including delivery costs) will be refunded immediately, but no later than 14 days after sending the notice.

4. Payment

The Customer pays for the goods in the payment environments offered by the seller. Before paying the invoice, the Customer shall check that the data provided in the invoice corresponds to the Customer's actual wishes. The Customer pays the full sales price and delivery fee as an advance payment. The seller sends a confirmation and an invoice to the customer by e-mail upon receipt of the order. The sales agreement between the seller and the customer enters into force from the moment the entire purchase amount paid by the customer is received in the seller's current account or the payment environment used.

5. Delivery

Goods are shipped to the following countries: Estonia. The buyer has the following options for receiving the goods: SmartPost parcel terminal. The seller assembles and posts the order after the purchase amount has been received. If the seller is unable to assemble the products requested by the customer, the seller will contact the customer to agree on a product replacement or compensation. The shipping costs of the goods are borne by the buyer, and the corresponding price information is displayed next to the shipping method. Shipments within Estonia generally reach the destination specified by the buyer within 3 working days from the entry into force of the sales agreement. In exceptional cases, the right to deliver the goods is up to 10 calendar days. The Online Store is not responsible for the delay in the delivery of goods if the goods have been handed over to the logistics partners on time, but the delay is due to circumstances that the Online Store could not influence or foresee.

6. Right of Withdrawal

After receiving the order, the Customer has the right to withdraw from the contract concluded in the e-store within 14 days. The right of withdrawal does not apply if the Customer is a legal entity. To exercise the 14-day right of return, the ordered goods must not be used in any other way than is necessary to verify the nature, characteristics, and functioning of the goods in the manner permitted for testing goods in a physical store. If the goods have been used for purposes other than those necessary to verify the nature, characteristics, and functioning of the goods, or if there are signs of use or wear, the Online Store has the right to reduce the refundable fee according to the decrease in the value of the goods. The right of return does not extend to products that have been opened after delivery and are unusable at the time of return for hygienic reasons. To return the goods, a declaration of withdrawal from the purchase must be submitted (form found here) and sent to the e-mail address luxlashes.ou@gmail.com no later than 14 days after receipt of the goods. The costs of returning the goods are borne by the buyer, unless the reason for the return is that the product to be returned does not correspond to what was ordered (e.g., wrong or defective product). The buyer must return the goods within 14 days following the submission of the application or provide proof that they have handed over the goods to the carrier within the aforementioned period. Upon receipt of the returned goods, the Online Store shall immediately, but no later than 14 days after receiving the withdrawal application, refund all fees received from the buyer under the agreement. The money will be returned to the same current account from which it was received by the Online Store. The Online Store may refuse to make refunds until it has received the item that is the subject of the contract or until the buyer has provided evidence that they have sent the item back, whichever occurs earlier. If the buyer has explicitly chosen a delivery method other than the cheapest conventional delivery method offered by the Online Store, the Online Store is not required to refund the cost exceeding the cost associated with the conventional delivery method. The Online Store has the right to withdraw from the sales transaction and demand the goods back from the buyer if the price of the goods in the online store is marked significantly below the market price of the goods due to an error.

7. Right to File a Complaint

The Online Store is responsible for the non-compliance of the goods sold to the buyer with the terms of the contract or a defect that already existed at the time of delivery and which appears within two years from the delivery of the goods to the buyer. Within the first year of delivery, it is presumed that the defect existed at the time of delivery. Rebutting this presumption is the obligation of the Online Store. In the event of a defect, the buyer has the right to contact the online store no later than within two months by sending an e-mail to luxlashes.ou@gmail.com or by calling: +372 554 0615. The Online Store is not responsible for defects that have arisen after the delivery of the goods to the Customer. The Online Store is not responsible for defects caused by the Customer's fault, which have arisen as a result of improper storage or non-intended use of the product. If a defect appears, please stop using the product. If the goods purchased from the Online Store have defects for which the Online Store is responsible, the Online Store will repair or replace the defective goods. If the goods cannot be repaired or replaced, the Online Store will refund all fees associated with the sales agreement to the buyer. The Online Store responds to the consumer's complaint in writing or in a format that can be reproduced in writing within 15 days.

8. Direct Marketing and Processing of Personal Data

The controller of personal data is Lux Lashes OÜ (online store www.luxlashes.ee), registry code 16818530, address Ringi 4, 80010 Pärnu, e-mail: luxlashes.ou@gmail.com. The Online Store uses the customer's personal data in accordance with the requirements established in the Personal Data Protection Act. The Online Store collects personal data that is strictly necessary for the fulfillment of orders placed in the e-store and for contacting the customer. The Online Store uses the personal data entered by the buyer only for processing the order and shipping the goods to the buyer. The Online Store transmits personal data to the transport service providers in order to deliver the goods. The Online Store transmits only the personal data necessary for making payments to the processor Maksekeskus AS. The Online Store sends newsletters and offers to the buyer's e-mail address only if the buyer has expressed a wish to do so by entering their e-mail address on the website and indicating their desire to receive direct mail notices. The Customer can opt out of offers and newsletters sent to the e-mail at any time by notifying us via e-mail or by following the instructions in the e-mail containing the offers. The Customer has the right to access their personal data and demand the correction or deletion of such data, except where otherwise provided by law. In case of any questions regarding personal data, the Customer has the right to send an e-mail to the Online Store: luxlashes.ou@gmail.com. The Online Store has the right to use the collected personal data to better understand the Customer's expectations and, based on this, make personal offers. The Online Store does not sell or disclose the Customer's data to third parties without your prior consent or in cases provided by law.

9. Settlement of Disputes

If the Customer has complaints regarding the Online Store, they must be sent to the e-mail address luxlashes.ou@gmail.com or by calling: +372 55 40615. If the Customer and the Online Store are unable to resolve the dispute by agreement, the Customer can turn to the Consumer Disputes Committee. The procedural terms can be viewed and an application submitted here. The Consumer Disputes Committee is competent to resolve disputes arising from the contract concluded between the Customer and the Online Store. The review of the Customer's complaint by the commission is free of charge. The Customer may also turn to the European Union's Online Dispute Resolution (ODR) platform.

10. Other Conditions

The images displayed next to the goods in the Online Store are for illustrative purposes. The Customer does not have the right to return the goods because the photo of the product packaging in the online store does not exactly match the packaging of the delivered goods, provided that the goods otherwise correspond to the order and match the info displayed next to the goods in terms of name, quantity, and characteristics. All product descriptions, photos, and other data on the Luxlashes.ee website are protected by copyright, and copying or using them in any other way without the consent of the online store owner is prohibited.

11. Force Majeure

The Online Store is not responsible for damages caused to the Customer or for delays in delivery if the damage or delay is due to circumstances that the Online Store could not influence or foresee.
